By accessing the website, purchasing a ticket, registering for an event, submitting information, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you should not use the website, purchase tickets, or participate in any services offered through the website.

1. About SwarmParty

SwarmParty is an event and ticketing platform connected with Swarm Movement. Our intention is to foster an inclusive underground dance music community grounded in high-quality house music, movement, connection, creativity, and shared community experience.

Our events are designed to be inclusive, respectful, non-judgmental, and welcoming to individuals of all sexual orientations, gender identities, backgrounds, and forms of expression. However, while we strive to create a respectful and positive environment, we cannot guarantee that every event, venue, attendee, third party, or circumstance will be free from risk, interruption, misconduct, inconvenience, or harm.

2. Eligibility and Use of the Website

You may use the website only for lawful purposes and in accordance with these Terms. By using the website, purchasing a ticket, registering for an event, or submitting information, you confirm that the information you provide is accurate, current, and complete, and that you have the legal authority to enter into transactions through the website.

Certain events may be subject to age restrictions, identification checks, venue rules, dress codes, security procedures, capacity limits, accessibility procedures, or other requirements. Where applicable, you are responsible for complying with all such requirements.

We reserve the right to refuse admission, remove any person from an event, cancel access, or deny future participation where necessary for safety, compliance, misconduct, disruption, non-payment, suspected fraud, violation of these Terms, or violation of venue rules.

3. User Accounts and Registration

You are responsible for all activity conducted through your account or using your submitted information.

4. Tickets, Event Access, and Orders

Tickets purchased through the website are valid only for the specific event, date, time, and venue listed at the time of purchase, unless otherwise stated by us in writing. A ticket purchase does not guarantee admission if the attendee fails to comply with these Terms, venue requirements, security checks, age restrictions, identification requirements, or applicable laws.

You are responsible for reviewing all event details before purchasing a ticket, including date, time, venue, pricing, refund terms, age restrictions, accessibility information, and any other applicable conditions. We are not responsible for errors caused by incorrect information entered by you during checkout.

Tickets may not be copied, duplicated, resold, transferred for commercial purposes, or used for unauthorized promotions without our prior written consent. We reserve the right to cancel, reject, or invalidate tickets that appear fraudulent, duplicated, improperly obtained, resold in violation of these Terms, or otherwise suspicious.

5. Payments and Third-Party Payment Processors

Payments for tickets or related services may be processed through third-party payment processors. We do not directly store full payment card details. By making a purchase, you agree to the applicable terms, fees, security procedures, and privacy practices of the payment processor used at checkout.

All prices are listed in the currency shown at the time of purchase and may be subject to applicable taxes, processing fees, platform fees, service charges, or other charges disclosed at checkout. Unless otherwise stated, all fees must be paid in full before ticket confirmation or event access is granted.

6. Event Changes, Postponement, or Cancellation

We reserve the right to change event details where reasonably necessary, including changes to venue, schedule, lineup, programming, format, performers, vendors, entry requirements, security procedures, or other event elements.

We may postpone, reschedule, relocate, modify, or cancel an event due to circumstances including, but not limited to, venue issues, safety concerns, artist or staff availability, weather, emergencies, public health concerns, governmental restrictions, technical issues, insufficient ticket sales or attendance levels that make the event commercially or operationally impracticable, operational issues, or other circumstances outside our reasonable control.

Where an event is cancelled, postponed, or rescheduled, any refund, credit, or transfer will be handled in accordance with our Refund Policy and any specific terms communicated for that event.

7. Attendee Conduct and Community Standards

SwarmParty is committed to maintaining a respectful, inclusive, safe, and welcoming environment. By attending an event or using the website, you agree not to engage in harassment, discrimination, intimidation, violence, abusive conduct, unwanted physical contact, unsafe behavior, illegal activity, unauthorized recording, misuse of tickets, or any conduct that interferes with the experience, safety, dignity, or rights of others.

We reserve the right to deny entry, remove any attendee, cancel access, or ban future participation where we believe a person has violated these standards, created a safety concern, disrupted an event, violated venue rules, acted unlawfully, or acted contrary to the values of the SwarmParty community.

Removal, denial of entry, or cancellation of access due to misconduct, safety concerns, suspected fraud, or violation of these Terms does not entitle the attendee to a refund.

8. Accessibility and Accommodation Requests

SwarmParty values inclusivity and seeks to create welcoming community experiences. If you have accessibility needs, accommodation requests, sensory concerns, mobility needs, or other participation-related concerns, you are encouraged to contact us in advance at info@swarmparty.com so we may review available options.

Accommodation availability may depend on venue rules, timing, event format, safety requirements, and reasonable operational limits

9. Safety, Assumption of Risk, and Event Participation

By attending a SwarmParty event, you understand that live events may involve inherent risks, including crowd movement, loud music, dancing, lighting effects, physical activity, venue-related risks, personal interactions, travel, weather, security procedures, and other circumstances outside our control.

You voluntarily assume all risks associated with attending and participating in events. You are responsible for your own health, safety, belongings, transportation, and personal decisions during and after the event. If you have any medical condition, sensory sensitivity, accessibility need, or safety concern, you should assess whether participation is appropriate and contact us in advance where reasonable.

To the maximum extent permitted by law, Swarm Movement, its organizers, officers, directors, staff, volunteers, contractors, partners, venues, artists, vendors, and representatives shall not be liable for injury, loss, damage, theft, delay, emotional distress, inconvenience, illness, or other harm arising from event attendance, except where liability cannot legally be excluded.

10. Photography, Video, and Event Media

SwarmParty events may be photographed, filmed, livestreamed, recorded, or otherwise documented for promotional, archival, community, security, social media, or operational purposes.

By attending an event, you acknowledge that you may appear in photos, videos, audio recordings, or other media captured in public or event spaces. To the extent permitted by law, you grant Swarm Movement permission to use such media for lawful promotional, marketing, archival, and community-related purposes without further compensation, unless prohibited by applicable law.

If you have a specific privacy or safety concern regarding event media, please contact us in advance at info@swarmparty.com, and we will review reasonable requests where possible.

11. Personal Belongings

You are responsible for your personal property at all times. We are not responsible for lost, stolen, misplaced, or damaged belongings at any event or venue. Any lost-and-found assistance is provided as a courtesy only and does not create liability for SwarmParty, Swarm Movement, or the venue.

12. Website Content and Intellectual Property

All website content, including text, branding, logos, event names, images, designs, graphics, videos, slogans, community language, SwarmParty concepts, “Swarmy” references, merchandise concepts, and other materials are owned by or licensed to Swarm Movement, unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell, exploit, scrape, republish, imitate, or use our intellectual property for commercial purposes without our prior written consent. Nothing on the website grants you ownership or license rights except the limited right to access and use the website for personal, lawful, and non-commercial purposes.

13. User Submissions and Communications

If you submit messages, inquiries, reviews, comments, images, feedback, or other content to us, you confirm that you have the right to provide that content and that it does not violate any law or thirdparty rights.

You grant us a limited, non-exclusive, royalty-free right to use such content for the purpose of responding to you, operating the website, improving our services, maintaining records, addressing safety or legal concerns, and, where applicable, promoting or documenting the community experience, subject to applicable privacy laws and permissions.

To the extent liability cannot be excluded, our total liability shall be limited to the amount you paid for the specific ticket or service giving rise to the claim, unless applicable law requires otherwise.

You agree to defend, indemnify, and hold harmless Swarm Movement and its officers, directors, staff, volunteers, organizers, contractors, partners, affiliates, venues, vendors, artists, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your violation of these Terms, misuse of the website, unlawful conduct, event misconduct, infringement of third-party rights, fraud, or harm caused to another person or property.

Any disputes arising from or relating to these Terms, the website, ticket purchases, or event participation shall be handled in the state or federal courts located in New York County, New York, unless another venue is required by applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, where permitted by law

24. No Waiver

25. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations as part of a restructuring, operational change, business transfer, legal requirement, or service transition.

These Terms, together with our Privacy Policy, Refund Policy, and any event-specific terms disclosed at the time of purchase, constitute the entire agreement between you and Swarm Movement regarding your use of the website, ticket purchases, and event participation. Where event-specific terms conflict with these Terms, the event-specific terms shall control only for that particular event.
